To keep things simple:
When you download, install, or use Honoku, you're agreeing to these Terms. If you're under 18, please check with a parent or guardian first. If you don't agree with something here, that's okay — just don't use the app.
Honoku is an evolving project, so these Terms might change over time. If I make significant changes, I'll let you know inside the app or by email at least 30 days before they take effect. Small fixes (typos, clarifications) just get updated on this page.
As long as you follow these Terms, you have a personal, non-commercial right to use Honoku on iOS devices you own or control. Think of it as a friendly handshake — you can use the app, but you don't own it.
All the parts of Honoku that make it work and look the way it does belong to me. That includes:
Your reading data — the books you log, the reviews you write, the quotes you save — stays yours. By uploading it to Honoku, you're giving me permission to store it, sync it across your devices, and show it back to you. That's it. I don't claim ownership of your reading life.
If you email me ideas, feedback, or feature requests (which I love, by the way), I might use them to improve Honoku without owing you anything for it. Just so we're clear.
When you sign up, please use real info. You're responsible for keeping your password safe and for whatever happens on your account. If you notice anything weird — like someone else logged in — email me right away.
One account per person, please. No sharing or reselling accounts.

Cancellation takes effect at the end of your current billing period.
All refund requests for Premium subscriptions go through Apple — that's how the App Store works. Visit reportaproblem.apple.com to request one.
If I need to adjust prices, I'll let you know at least 30 days before the change. You can cancel before the new price kicks in.
When you add books, write reviews, save quotes, or upload covers, that's your content. You keep ownership. By using Honoku, you're just giving me permission to store and display it back to you — that's how the app works.
You're responsible for what you upload. By adding content, you confirm:
When you save a passage from a book, the original author and publisher still own that text. Honoku lets you keep these quotes for your personal use under the principle of fair use / legitimate quotation — I don't redistribute them or share them with other users.

I really hope this never happens, but I do reserve the right to suspend or terminate access if:
You can leave Honoku anytime by deleting your account from inside the app (Profile → Delete my account) or by uninstalling. No hard feelings. Note that already-paid subscription periods don't get refunded.
After your account is closed, certain provisions of these Terms stay in effect — particularly the ones about intellectual property, liability limits, and governing law. That's standard.
I'll do my best to keep Honoku running smoothly, but I can't promise it'll be perfect 24/7. Sometimes there's maintenance. Sometimes things break. Sometimes the internet just has a bad day.
I also reserve the right to modify, suspend, or discontinue features over time as the app evolves.
I take Honoku seriously and I want it to work well for you. That said, like every app developer, I need to set some boundaries on my liability — otherwise indie apps wouldn't be financially sustainable. Here's the deal:
I'm not responsible for indirect damages. If something goes wrong (an outage, a bug, data loss), I'm not liable for things like lost revenue, lost opportunities, emotional distress, or reputation damage. To the maximum extent the law allows, my responsibility is limited to direct, demonstrable harm.
There's a cap on what I owe. If something I do (or fail to do) genuinely causes you direct harm, the most I can be required to pay is either: (a) what you paid Honoku in the 12 months before the problem, or (b) US$ 50, whichever is greater. This is normal for indie apps — without this kind of cap, no individual developer could afford to make an app like this.
This applies under any legal theory (contract, negligence, you name it) and stays in effect even if a specific remedy doesn't fully resolve a problem.
Honoku comes "as is" and "as available." I can't promise it'll be perfectly bug-free, never crash, or always meet your specific expectations. I can't guarantee the app won't have downtime, that data won't ever be lost in extraordinary circumstances, or that every feature will work exactly the way you imagined.
To the extent the law allows, I'm disclaiming implied warranties like merchantability and fitness for a particular purpose. In plain English: I'll do my best, but I can't make legal promises about software perfection — nobody can.
If you do something that gets me sued or causes me legal trouble — like uploading content that infringes someone's copyright, violating these Terms, or using Honoku for something illegal — you agree to cover the costs I incur (including reasonable legal fees). This is called "indemnification" in legal-speak, and it's a standard protection for app developers.
Whenever you want to leave, you can delete your account directly from the app:
This is permanent and your data will be removed within 30 days. (This option exists because Apple requires it in Guideline 5.1.1(v), and honestly, it's just the right thing to do.)

Honoku relies on a few partners — Apple, Google, RevenueCat, and Hetzner — to function. I'm not responsible for things they do (or fail to do): outages on their end, changes to their policies, or issues with their services. Each of them has their own terms and policies, which you can read on their sites.

I'll investigate every claim. As Apple requires, I'm the one responsible for handling these — not Apple.
Since Honoku is distributed through the App Store, Apple requires me to include these specific clauses:
18.1 — This agreement is between you and me (Eyner Córdova), not Apple. Apple has no responsibility for Honoku or its contents.
18.2 — Your license is limited to using Honoku on iOS devices you own or control, per the App Store's Usage Rules.
18.3 — Maintenance and support is my responsibility, not Apple's. If you need help, contact me.
18.4 — If Honoku doesn't conform to an applicable warranty, you can notify Apple and Apple may refund your purchase. Beyond that refund, Apple has no warranty obligations.
18.5 — I (not Apple) am responsible for handling any claims about Honoku from you or third parties.
18.6 — If someone claims Honoku infringes their intellectual property, I'm responsible for investigating and resolving that — not Apple.
18.7 — You confirm you're not in a country that the US has embargoed or designated as a terrorism-supporting state, and you're not on US government restricted parties lists.
18.8 — Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.
Since I'm based in Lima, Peru, these Terms are governed by Peruvian law. If something ever needs to go to court, the courts of Lima would handle it — unless consumer protection laws in your country give you stronger rights (which sometimes happens, and that's totally fine).
Before going to court, let's try talking first. We both agree to attempt to resolve any conflict directly through good-faith conversation for at least 30 days before involving lawyers. I'd much rather solve things by email than in a courtroom.
These Terms, together with the Privacy Policy, are the full deal between us. Any previous conversations or promises are replaced by what's here.
If a court ever decides one part of these Terms isn't enforceable, the rest of the Terms still applies. We'd just need to replace the invalid part with something similar that works legally.
Just because I don't immediately enforce something doesn't mean I've given up the right to enforce it later.
You can't transfer your account or these Terms to someone else without my written okay. I might transfer my side of things in the future (for example, if Honoku ever becomes a company).
If something major happens that's truly outside my control — natural disasters, government actions, massive cyber attacks, pandemics, prolonged internet outages — I can't be held responsible for failures caused by those events.

These Terms are originally in English. A Spanish version is also available. If they ever conflict, the English version wins.
